Adult Waiver, Release of Liability, and Consent Agreement
For Participants 18 Years of Age or Older
Surge Dance Competitions, LLC (“Surge”, “Surge Dance Comps”, “we”, “our”, or the “Company”)
Important: This is a legally binding document. Please read carefully before signing.
I, the undersigned adult participant (“Participant”), hereby acknowledge, agree, and affirm the following on behalf of myself and my heirs, assigns, personal representatives, and next of kin:
1. Voluntary Participation & Assumption of Risk
I understand that participation in Surge events involves physical activity and may include risks of injury, emotional distress, permanent disability, illness (including COVID-19), or death. I voluntarily choose to participate, fully understanding and accepting all associated risks.
2. Release and Waiver of Liability
To the fullest extent permitted by law, I release and discharge Surge Dance Competitions, LLC and its affiliates, employees, venue hosts, and agents (“Releasees”) from any and all liability for injuries, illnesses, damages, losses, or claims arising out of my participation in the Event(s), whether caused by negligence or otherwise.
3. Indemnification
I agree to defend, indemnify, and hold harmless the Releasees from any claims, damages, legal fees, or losses arising from my conduct during the Event(s).
4. Medical Authorization
I authorize Surge staff to obtain emergency medical care for me in case of an emergency and accept all responsibility for resulting costs.
5. Media Release
I grant Surge full rights to use my image, voice, and likeness in any marketing, promotional, or commercial materials without compensation.
6. Music Licensing
I understand studios are responsible for ensuring all performance music is properly licensed. I release Surge from any claims arising from unlicensed music use.
7. No Refund Policy
I acknowledge that all fees and deposits paid are final and non-refundable. I agree not to initiate any chargebacks or payment disputes.
8. Governing Law & Jurisdiction
This waiver is governed by the laws of the State of Utah. Disputes must be resolved in Salt Lake County, Utah.
